Helping You Get Past the Bankruptcy Stay
Whenever someone files for bankruptcy, the bankruptcy court places an automatic stay on foreclosures, repossessions and collection lawsuits by creditors, preventing them from moving forward.
However, in some cases, debtors continue to have repayment obligations after filing for bankruptcy. For instance, someone operating under a Chapter 13 repayment plan still must meet the terms of that plan.
When a bankrupt debtor owes you a non-discharged debt and has not made payments on time, you cannot take collection actions - including foreclosure or repossession - until you have filed a motion to vacate (cancel) the automatic stay.
That is where I step in. I have extensive experience with motions to vacate and can provide skilled creditor bankruptcy representation.
